Below you will find the policies for our in-class courses, online courses, online workshops and Health and Fitness Alliance Inc.'s FitKey Membership and Collections. Please read this Policies Page before making your purchase.

In-Class Course Policies

There are no refunds on in-class courses, with the exception that an instructor cancels the course due to lack of registration, illness or other circumstances. In this case, we will issue a full refund or you may choose to transfer your registration into the next available course date. Our no-refund policy is designed to ensure the course runs so all participants can complete their courses as anticipated. Your in-class course certificate will be sent to you via email in PDF format or will be giving to you in hard-copy form on the last day of the course (upon successful completion of course requirements). Please note that there is a $10.00 + HST administration fee for re-issuing certificates should you require one re-issued to you.

All deferrals must be made at least 10 days before the course's start date. Only one deferral will be granted.

Online Courses

There are no refunds on online courses. We process & ship our courses within 24 hours or immediately delivered electronically. Your course certificate will be sent to you via email in PDF format. Please note that there is a $10.00 + HST administration fee for re-issuing certificates should you require one re-issued to you.

Online Fitness & Professional Development Workshops

There are no refunds on online courses or workshops. We process & ship our workshops within 24 hours or immediately delivered electronically. Access to fitness and professional development workshops is granted for 3 months from the date of activation. Upon expiration, your access to the workshop materials will end (with the exception of the hard copy booklets sent to you for professional development workshops). Should you desire further access to the workshop material after expiration, you may re-purchase the workshops. Your workshop certificate will be sent to you via email in PDF format. Please note that there is a $10.00 + GST administration fee for re-issuing certificates should you require one re-issued to you.

Acceptance of Terms of Use

IT IS IMPORTANT THAT YOU READ ALL THE TERMS AND CONDITIONS CAREFULLY. Health and Fitness Alliance Inc. owns and operates this Web, located at http://www.healthandfitnessalliance.com (the Web site). This Terms of Use Agreement (this Agreement) states the terms and conditions under which you may access and use the Web site. By accessing and using the Web site you are indicating your acceptance to be bound by the terms and conditions of this Agreement. If you do not accept these terms and conditions, you must not access or use the Web site. IF YOU ARE DISSATISFIED WITH THE TERMS, CONDITIONS, RULES, POLICIES, GUIDELINES OR PRACTICES OF THE Health and Fitness Alliance Inc. OPERATING WEB SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING IT. Health and Fitness Alliance Inc. may revise this Agreement at any time by updating this posting. Use of the Web site after such changes are posted will signify your agreement to these revised terms. You should visit this page periodically to review this Agreement.

This agreement applies to and encompasses all FitKey Express, FitKey and FitKey Professional members. By subscribing to this service, you agree that you have read, understand and agree to these terms and conditions of use. You agree to review this agreement periodically in order to be aware of modifications to the agreement. The rights granted under the agreement are effective only upon payment of the non-refundable subscription fee.

2. Terms of Membership:
All memberships are annual, no exceptions.
There will be no extensions under any circumstances. However you may purchase an extension should you require more than a year to complete your courses.

You will not receive a hard copy of the course manuals with your membership. For most of our courses, the manual or workbook will be downloadable online*. However, if you would like a hard copy, you may purchased it separately through our online store.

Certificates will be issued once all course material has been completed.

Health and Fitness Alliance Inc. does not take responsibility for educating users on how to use a computer or the internet.

Health and Fitness Alliance Inc. does not take responsibility for any problems which arise related to the changing of names, place of residence, email addresses or phone numbers.
 

3. Fees:

The term "yearly” or “annual” subscription is defined as one 365-day period. All subscriptions are non-refundable and are for the duration of one year. It is recognized and understood that the fees you (the user) pay are strictly for access to our suite of educational materials, for the aforementioned 365-day period of time. Your fees do not include the purchase of any physical manuals, documents, or other supplemental materials, nor do they confer ownership of any materials (online, physical, or otherwise) to the user. At the time and date of expiration of the user’s account, their rights to access our educational materials cease, and they retain no ownership over any courses, workshops, or content of any kind.
 

4. Access to Membership Areas:

Health and Fitness Alliance Inc. strives to provide its online content to its subscribers on a continuous basis. To that end, Health and Fitness Alliance Inc. will take all commercially reasonable efforts to provide uninterrupted access to the online content to its subscribers. However, from time to time, subscribers may be unable to access our online content due to conditions beyond Health and Fitness Alliance Inc.’s control. Such conditions include, but are not limited to: Force Majeure or Acts of God, power outages, and the acts of computer hackers and others acting outside the law. Also, from time to time, access may be unavailable due to software issues, programming errors, regular maintenance of the system, and other related reasons. In response to any unavailability of our online content to its subscribers, Health and Fitness Alliance Inc. will take all commercially reasonable steps to ensure access is restored within a reasonable period of time. The term commercially reasonable shall be determined solely by Health and Fitness Alliance Inc.

Access to the online material will only be available for the duration of your subscription. Once you have discontinued your subscription, you will no longer have access to any documents, videos, quizzes, tutorials, etc.
 

5. Prohibited Conduct:

User expressly agrees to refrain from doing, either personally or through an agent, any of the following:

Transmit, install, upload or otherwise transfer any virus, advertisement, communication, or other item or process to the Site that in any way affects the use, enjoyment or service of the Site; adversely affects Health and Fitness Alliance Inc.’s computers or databases; Otherwise engage in any action which Health and Fitness Alliance Inc. determines is detrimental to the use and enjoyment of the Site.
Capture, download, save, upload, otherwise retaining information and content available on the Health and Fitness Alliance Inc. other than what it expressly allowed by the terms of this agreement; Copy, modify, reverse engineer, disassemble, redistribute, republish, alter, or adapt any of the software, information, text, graphics, source code or HTML code, or other content available on the Site. Remove or modify any copyright, trademark, legal notices, or other proprietary notations from the content available on the Site; Violate Health and Fitness Alliance Inc.’s security mechanisms, access any data or server you are not authorized to access; or otherwise breach the security of the Site or corrupt the Site in any way; Use any device or other means to harvest information about other Users.

In order to ensure that Users of the Site do not engage in Prohibited Conduct, Health and Fitness Alliance Inc. reserves the right to monitor use of the Site and reserves the right to revoke or deny Access to the Health and Fitness Alliance Inc. to any person or entity whose use of the Site suggests Prohibited Conduct. Access of the online materials beyond that of normal patterns of use that suggests systematic copying of the materials constitutes abuse of our online material and will result in revocation or denial of access to the online material. The terms “normal patterns” and “abuse” shall be determined solely by Health and Fitness Alliance Inc.
 

6. Copyrights and Trademarks and other Proprietary Rights:

Health and Fitness Alliance Inc. shall retain all worldwide rights in the intellectual property of the Site, including, but not limited to, trademarks, inventions, ideas, trade secrets, the "look and feel" of the site, its color combinations, layout, and all other graphical elements, and the copyright in and to its original content. You should assume that everything you read or see on the site is copyrighted or otherwise protected and owned by Health and Fitness Alliance Inc. or a third party who licensed the right to use such content to Health and Fitness Alliance Inc.. Unless otherwise expressly noted, nothing that you read or see on the site may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use without the prior written consent of Health and Fitness Alliance Inc. except as provided in this Agreement.
 

7. Security:

Users are prohibited from violating or attempting to violate the security of the Site. Health and Fitness Alliance Inc. will investigate occurrences of possible violations and will cooperate with all applicable law enforcement authorities in prosecuting violators. Users are required to enter a username and password to access the Online Content. In order to protect against unauthorized access to your account, it is recommended that you close the browser when you have finished using the Site.
 

8. Privacy Statements:

Health and Fitness Alliance Inc. values your trust. In order to honor that trust, all of Health and Fitness Alliance Inc.’s owners, employees and contractors are required to adhere to the highest ethical standards in gathering, using, and safeguarding any information you provide. Personal Information is gathered only when users make voluntarily online submissions of such information or voluntarily establish an account. An example of the type of information Health and Fitness Alliance Inc. collects is: name, address, city, province or state, country, postal code, telephone number and email address. Health and Fitness Alliance Inc. does not rent, sell, or exchange information about Website visitors and generally restricts access to user information to qualified Health and Fitness Alliance Inc. employees. Third parties who need access to Health and Fitness Alliance Inc. user information in order to provide operational or other support services are required by Health and Fitness Alliance Inc. to comply with our high standards of security. We gather only the user information that is needed to administer our business and enhance and improve our services.
